Having such a big fan base, I thought this would be common knowledge but it sounds more like an episode of "The Prisoner" the more we/I try to unravel things. Where or more to the point to whom, do the spoils go to? Ultimatley that is. |
I assume its two main beneficiaries - the publisher/rights holder (Island?) and his remaining family. _________________ Where are the crimson leaves,

| I totally hate it that the song is chopped up like that. This wonderful song must be listened to as it flows....as it is meant to be. I find it disturbing and I can't even watch the commercial. |

I find this an appropriate and worthwhile thought from forum member Silver Plane, who several years ago commented on a previous controversy dealing with Nick's music in advertising:
I've linked above to this earlier thread wherein this post may be found in context. The comments below are not in response to the current AT&T ad but relate to an earlier advertisement for cough medcin, or perhaps an anti-phlogiston device, or perhaps an anti-thought shield, or perhaps even an ad for Nuclear Armaments,, I have no idea cuz i never saw, nor heard such ad, (it never made it to North America... gosh darn) but I believe it had something to do with clearing ones throat. Ahem.
But if Nick can sell AT&T I don't see why he couldn't sell ICBM's

In this day and age there's very little chance the estate could have said no to this advert. Most record (and publishing) deals are set up to allow companies to pay 'blanket' licenses and use whatever music they like in ads. It's not necessarily right but is generally the way the business of music is conducted these days.

I'm not sure about this. Some artists are still able to refuse such offers: Sigur Ros were recently on telly saying that they'd turned down an estimated £2 million from advertisers because they were against their music being used to sell a product. If Nick's publishing deal means that the Estate isn't able to say how and where his music is used then they shouldn't have entered into said deal in the first place. It leaves me wondering exactly what powers they do have.
I don't think I could have put it better.

In the past week I've had 2 different emails from people (not Nick fans particularly) telling me how much they hate the ad and saying it's put them off listening to any more Nick Drake. I've politely explained that I have nothing to do with it (and corrected the person who started his email 'Dear Nick').
Seems some people don't much like it!

I looked at this add for the first time in a couple months.,
Noticed that there was a disclaimer at end of ad
dissassociating them from Jeanne Claude and Christo;
Which disclaimer had not been there before.
This I suppose because enough people had
complained about the usage of imagery which
struck them as clearly derivitave of their (Jeanne
Claude and Christo's .... well actualy just Christo's)
work.
But you can't make that complaint about `From the Morning'.
Nope, nothin derivitave about it, just a butchered copy of
Nick's song, bought and paid for. Nothin to complain about.
Use it as you will.
If you check a few of the other AT&T adds in this series you'll find
these commonalities:
All adds are about 30 seconds long.
Most adds have around 20 discrete images per add
(just long enough to make an emotional imprint on
human nervous system)
Many have an emotionally packed soudtract:
Lou Reed - Perfect World;
Gene Wilder-Pure Imagination
Nick Drake -From the Morning
None of them have any specific information about
what they're actually selling or what it will cost you
to buy.
Once was a time when an advertisement meant
`this is what we got, and this is how much it cost'
But for a long time now advertising has been
`We've got something (and it doesn't even
matter what it is ) and if you buy it
you'll be able to acquire whatever
fantastic hollywood notions you
have about your life and the world,
just so long u buy it.'
And such suasion is made subversively, by appeal to
associative imagery and emotional response to such
imagery.
And we got Nick Drake shillin for that.
egads what a world. |

Think I am happy I can't watch that video here.
Last I heard from someone wanting to use Nick Drake covers Cally said some of the rights were with the estate and some still with the music companies. Now island records has been eaten by Universal and big companies do almost anything for the money... _________________
